Training visa (subclass 407)

407 PURPOSE: the Applicant is to complete workplace-based training (to improve your skills for your current occupation, area of tertiary study, or field of expertise), or a professional development training program. To sponsor someone for a Training visa (subclass 407), the employer or training provider must also be able to show that you can directly provide training, unless you are a national Australian Commonwealth Government agency or have an exemption.

 

PROCEDURE:

Step 1: sponsoring organisation has applied to be or has been approved as a sponsor.

 

To sponsor someone for a Training visa (subclass 407) the sponsoring organisation must also be able to show you can directly provide training, unless you are a national Australian Commonwealth Government agency or have an exemption. Sponsoring organisation needs to provide the following documents for sponsorship application:

  • your certificate of registration for tax purposes showing your Australian Business Number (ABN)
  • your business names extract, if you operate under a trading name
  • your Australian Securities and Investments Commission (ASIC) registration and historical company extract, if your organisation is a company
  • the pages listing the parties to your franchise agreement and the signature pages of the agreement, if you operate under a franchise
  • the pages listing the parties to the trust and signature pages of the trust deed, if you operate under a trust
  • your ASIC registration and historical company extract, if the trustee of the trust is a company
  • a tax exemption certificate, if your organisation is not for profit

 

Businesses that have been operating for less than 12 months must provide evidence of active operation and ability to comply with sponsorship undertakings, such as:

  • a detailed business plan
  • a contract of sale for the purchase of the business
  • a lease agreement for the business premises
  • contracts for service provision
  • evidence that you employ staff
  • Business Activity Statements for each complete quarter from the date you commenced operations to the date of lodgement
  • bank statements

 

Evidence that the sponsoring organisation can meet your obligations:

  • bank statements for at least the previous 6 months
  • most recent tax return
  • profit and loss statements and balance sheets for the last financial year
  • a letter of support from a qualified accountant who is CPA, CA or Institute of Public Accountants (IPA) registered
  • a letter of support from a reputable financial institution that clearly summarises your organisation’s ability to meet its financial responsibilities

 

Step 2: sponsoring organisation must also have submitted a nomination application.

 

One of the key requirements for the nomination is for the sponsor to provide a copy of a detailed training plan. You may ask a professional plan drafter to draft a training plan for you. The costs may range between $1,100 and $1,500, and the turnover time may be around 2-3 weeks. You need to provide the following documents at least to them:

  • Company organisational chart;
  • Company details;
  • Nominee’s updated resume;
  • Trainer’s/Supervisor’s or Director’s qualifications and/or experience;
  • Trainer’s full name;
  • Position based on ANZCO code;

 

 

Step 3: Visa application

 

For visa applicant, please bear in mind the visa applicant also needs to provide the following evidence besides personal ID documents, qualifications and work experience:

 

  • show evidence of your financial capacity to support yourself and your family while you are in Australia, such as:
  • bank statements
  • a letter from your financial institution stating your financial position
  • employment contracts
  • documents showing allowances, accommodation and stipends from your sponsor while you are in Australia
  • if you are currently or were previously an AusAID or Foreign Affairs supported student provide a copy of the letter of support from the Department of Foreign Affairs and Trade
  • Health insurance
  • Evidence of English language
  • Character documents
  • You must provide a letter from the relevant regulatory body for the occupation in Australia or your home country. This letter must name you and state the nominated training is necessary for the you to get registration, membership or licensing to work in the occupation

 

  • Provide a statement from your sponsor confirming they are satisfied:
  • that you are doing the professional development training specified in the application
  • that you have relevant managerial or other professional skills and work experience to participate in the program

 

  • Provide a signed letter on company letterhead from your current manager detailing your current position and duties
